La crisi conseguente alla rapida ed allarmante diffusione del c.d. “nuovo Coronavirus” in molti Paesi europei (l’Italia in testa) ha riattivato talune problematiche tutt’altro che ignote all’assetto dei rapporti fra UE e Stati membri, con particolare riferimento a quegli Stati che hanno manifestato nel tempo qualche difficoltà a mantenere un certo rigorismo contabile, anche in ragione del rilievo costituzionale ivi occupato dai diritti sociali tipici del welfare state.
Abstract
The emergency following the widespread diffusion of CoVid-19 highlighted the problems related to the guarantee of social rights (not only the right to health) in many European countries. At the same time it re-opened the debate on the role of the European Union in the economy. The article analyses the importance of social rights in the relationship between the Italian Constitution and European law, with a focus on different standards of protection and different ideological backgrounds. Subsequently, it addresses the impact of European economic governance and budgetary constraints on the guarantee of social rights by States, stressing on the lack of European political sovereignty. Finally, through the analysis of some European instruments launched in response to the pandemic crisis, the perspectives of the European Union between regulatory and intervention role are analysed.
